It is possible your 40gig is partiotioned into multiple logical drives. Like maybe c:near 10gig and d: with 30 see

Some people do this to put the operating system on the first 10 and background on the remainder. that way if you enjoy to reload the os your data remains intact.

I could be wrong but it's something to check out. Software similar to Partition Magic can resize partitions lacking causing you to hold to reload windows.
Check the Administrative Tools;

Go to Control Panel, Admin Tools, Computer Management, later Disk Management, and see what is happening. You can after re-allocate the items on the disk; If that Fails, then Using Fdisk Carefull, to check the Part-info should be used
I'd also check if possibly your intricate drive is partitioned. If you show more then one are disk that may basically be a second partition on the one drive or it may hold just created the dividing wall form unpartitioned space if you had an install only just.
One thing is ----

The Decimal Capacity of a 40GB HDD is

40GB

The Binary Capacity is

37.25GB

So that your first loss.

Also

In Disk Management, see if the other loss is within

Unallocated Space, if shown
Where are you getting that information from?

Is your disk partitioned?

Are those figures referring to one drive on a partitioned disk?

Click on My Computer and afterwards right click the C: drive and select properties and see what that says underneath the General tab.
